Terms of Use of the Meteorological Service of Catalonia (SMC)

Introduction and identification data

These Terms of Use regulate the access and permitted uses of the website with the URL https://www.meteo.cat/ and the services contained therein (hereinafter the website) for the purposes of Law 34/2002 on information society services and electronic commerce.

The owner of this website is the METEOROLOGICAL SERVICE OF CATALONIA (METEOCAT) with registered address at Carrer Dr. Roux 80, Barcelona (CP-08017), and with Tax ID number (NIF) Q-0801167-H

The domain name meteo.cat is the property of the Government of Catalonia, Ministry of the Presidency.

METEOCAT is the official meteorological service of the Government of Catalonia. It was created by Law 15/2001, of 14 November, on meteorology, as an entity with its own legal status, and currently under the auspices of the Ministry of Territory and Sustainability.

Terms of access and use of METEOCAT

General information

The USER must accept these Terms of Use in order to use this website.

USERS may, nevertheless, download, store, reproduce and print a copy of these Terms of Use.

The Terms of Use are supported by the following:

  • General Terms of Purchase of Products and Publications
  • Individual Terms of each Product and Publication

Access to the website is free for any USER, notwithstanding the fact that access to certain services provided through the website, as well as the purchase of products, come at a price and are subject to their respective individual terms.

USER information

The registration form does not need to be filled in to view the information and services that METEOCAT offers on the website.

Only when purchasing products and/or services must the USER fill in the forms for this purpose. In any case, the USER states that they are over 14 years of age and that the information provided to METEOCAT, especially their personal data, is accurate and truthful, and they undertake to make the necessary modifications when this information changes.

Obligations of USERS when accessing METEOCAT

USERS when accessing and using the website assume obligations that include, but are not limited to, the following:

  1. Act in good faith with respect to METEOCAT and other USERS.
  2. Respect current legislation on intellectual and industrial property rights, image rights, privacy rights, the private property rights of both METEOCAT and other USERS and/or third parties.
  3. Not disseminate information or content that is not truthful or that may be slanderous or offensive to other USERS and/or any third party and/or METEOCAT; as well as not disseminate information or content that implies any type of discrimination and/or offences based on sex, sexual orientation, race, religious and/or political beliefs or that may be considered offensive in general and/or contrary to good conduct.
  4. Not establish links with other websites whose content may be offensive and/or discriminatory in the terms of the previous paragraph or to websites that are illegal or contravene the purpose of METEOCAT.
  5. Not use the website improperly, for other purposes and/or hindering its use and its own purpose.
  6. Not use the website for activities which are illegal and/or violate these Terms of Use.

Intellectual and industrial property of METEOCAT

USERS can freely view the information and content of the website, except that which must be contracted or paid for in advance.

The total or partial content of the website, including but not limited to any visual display, graphics, infographics, data, texts, databases, images and videos contained therein, are the property of METEOCAT or other third parties that have authorized it, and are protected by the legislation on intellectual and industrial property and by International conventions in this matter, without prejudice to the rights of third parties and with the exception of any content entered by USERS, which belong to them and are, where appropriate, protected by copyright and other laws.

By uploading content to the website USERS are granting METEOCAT the corresponding authorizations and licences for it to be hosted on the website and made interactively available, subject to the terms and conditions contained on the website.

However, the software applications used in the programming of the website are the property of METEOCAT or its software providers and are protected by national laws and international treaties and conventions on the matter. In this respect, METEOCAT uses youtube?s API Services in accordance with its API Client Terms of Service (you can consult them at this link: https://www.youtube.com/t/terms. With respect to this website and its contents, the following non-exhaustive list of actions are not permitted:

  1. Any form of public communication, by any means, including making the works contained on the website available to the public, so that anyone can access them wherever and whenever they want.
  2. Any form of distribution of any material obtained from the website, including, but not limited to, its sale, rental and/or loan.
  3. Any form of direct or indirect, temporary or permanent reproduction, by any means and in any form of all or part of it, including reproduction for private purposes and downloading to the USER's computer.
  4. Any form of transformation, total or partial, of any kind of content on the website.
  5. Any form of access and/or exploitation that includes the above or other forms.
  6. Any form, direct or indirect, of extraction and/or reuse of all or a substantial part of the content of any database; and/or the repeated or systematic extraction and/or reuse of non-substantial parts of these.

However, in accordance with Law 37/2007, on the reuse of public sector information, USERS who wish to reuse content protected by METEOCAT's intellectual property rights can contact it in order to obtain a licence for this reuse.

The USER acknowledges that the brands, names, logos and other distinctive signs contained on the website are elements owned by METEOCAT and/or the Government of Catalonia or, where appropriate, other third parties, protected by national laws and international treaties on industrial property rights. The unauthorized or improper use of these elements constitutes an infringement of the industrial property rights of METEOCAT or of these third parties.

Information contained in METEOCAT

Without prejudice to the foregoing point and point 9 (METEOCAT's liability disclaimer), the information that is contained and freely offered on this website, provided that it is not subject to intellectual property rights, may be used by USERS in accordance with the provisions of Law 18/2015, of 9 July, which amends Law 37/2007, of 16 November on the reuse of public sector information, subject to the following conditions:

  1. That the content of the information is not altered.
  2. That the content of the information is not distorted.
  3. That the source is acknowledged.
  4. That the date of the last update is shown.

Content provided by USERS

The USER guarantees METEOCAT that all the content provided and hosted on the website by the former, including but not limited to, images, videos, music, texts, symbols, logos and graphics, are the former's exclusive property and they have all the rights and/or failing that the USER has the mandatory authorizations of third party owners for said content and/or information. The USER assumes any liability for a breach of this condition, which is of essential importance for METEOCAT, who will be held harmless thereof.

The USER grants METEOCAT a non-exclusive licence for the reproduction and public communication of said content of all kinds, so it can be hosted on the website and made available to the public through the website as well as through any of the METEOCAT?s current or future social media channels (Facebook, Twitter, youtube).

This authorization also includes the right to transform this content in order to adapt it to the format and visual display of the website and/or other social media channels.

These terms will also apply to the content that USERS publish on METEOCAT?s social media profiles (Facebook, Twitter, youtube, and any other in the future) as long as this is permitted by the social media?s own regulations.

Procedure in the event of illegal activity

If the USER believes that any illegal use is being made of the content on the website or of websites accessible through the website and, in particular, a violation of intellectual or industrial property rights, image rights, private property or other rights, they must send a notification to METEOCAT, at the email address smc.meteocat@gencat.cat, which contains the following:

  1. The claimant's personal data: name, address, telephone number, and email address.
  2. Details of the alleged illegal activity carried out on the website and, in particular, in the case of an alleged violation of rights, precise and specific details of the protected content as well as its location on the websites.
  3. In cases where rights have been violated, a handwritten signature, with the personal data of the owner of the rights allegedly infringed or their representative.
  4. An unambiguous and clear declaration of responsibility by the claimant that the information provided in the notification is accurate and of an illegal nature regarding the use of the content or the performance of the activities described.

The information and elements contained in the linked websites are not the property of METEOCAT. The ownership of these elements is protected by intellectual and industrial property laws. Consequently, METEOCAT is not liable for the information that the USER obtains through the hypertext links that appear on the website which are not managed directly by our webmaster.

In the event that a third party wants to establish a link to this website, a link should be entered, if possible, on the homepage of the website. Other types of link can be created as long as the METEOCAT URL is maintained.

In any case, links to this Website from websites that contravene the law, morality or public order or that may otherwise threaten the reputation of METEOCAT are prohibited.

METEOCAT reserves the right to make changes to these Terms of Use without prior notice, which will come into effect after seventy-two (72) hours.

METEOCAT does not guarantee the absence of interruptions or errors when connecting and/or accessing to the website and its content; nor does it guarantee that it will be updated.

METEOCAT will endeavour to carry out, in the shortest possible time, updates and corrections of any errors detected, and to correct any deficiencies or errors in the access and/or connection to the website and its content.

USERS are solely liable for the access and use they make of the website and the content owned by METEOCAT or by other USERS, including when this content is hosted on the social media websites which METEOCAT subscribes to. All this, without prejudice to any legal proceedings that METEOCAT or other USERS and/or third parties may be entitled to for any improper use or access to the Website and its content and, in particular, for any attack, suppression, elimination or destruction of technological measures that, where applicable, protect their own content and that of the USERS.

METEOCAT will not be liable for any security errors that may occur or for any damage that may be caused to USER IT systems or the files or documents stored therein for access and/or connection to the website, nor for any damage that may be caused by third parties through illegitimate interference beyond the control of METEOCAT.

METEOCAT will not be liable for errors, inaccuracies or omissions in the information and especially in the predictions that it provides, and it is therefore exempt from any liability regarding its reliability, usefulness, reuse and, in particular, regarding any USER expectations that are generated.

METEOCAT will not be liable for any breach of the obligations that USERS assume when accessing and using the website, which are included in these Terms of Use.

Legislation and jurisdiction

Any potential disputes related to this website will be governed exclusively by Spanish Law and the laws of the Autonomous Community of Catalonia, for which only the Courts of Barcelona will be competent. Any person using the website, regardless of the territorial jurisdiction in which they access it, accepts compliance with and respect for this clause, expressly waiving any other jurisdiction that may correspond to them.
